The terms of use of the mobile application represent the Agreement (hereinafter referred to as the Agreement) on the use of the mobile application between the Limited Liability Company "GETMOBIT" and the end user (hereinafter - "User" or "You / Your").
Before using the mobile application (hereinafter referred to as the Application), please read the terms of this Agreement. By downloading or installing the Application on your Mobile device, you confirm your full and unconditional acceptance of the terms hereof. If you do not accept the terms of this Agreement in full, you are not entitled to use the Application for any purpose. For the avoidance of doubt, if you downloaded the Application, but in the future refuse the terms of this Agreement, you must immediately remove the Application installed from your Mobile device (cancellation of this Agreement is possible only by removing the Application from your Mobile device).
1.1. Company - GETMOBIT Limited Liability Company, which is the developer of the Application (hereinafter referred to as GETMOBIT or we / us / our). The address for communication and sending suggestions and comments on the work of the Application is indicated below.
1.2. User - an individual who downloaded the Application to his/her Mobile device.
1.3. Application - a set of programs and databases for computers under the name GM MOBILE ASSISTANT. The exclusive right to the Application belongs to the Company.
1.4. Mobile device is a smartphone on which the Application is installed.
NOTE.
On some Mobile devices, there may be problems with the support of the Application.
1.5. By using the Application, the User unconditionally agrees that an integral part of this Agreement is the Privacy Policy posted on the Internet at: http://docs.getmobit.ru/privacy_policy_en.html.
1.6. You also agree that the Agreement or the Privacy Policy may be changed without any special notice, the new edition of the documents comes into force from the moment they are published on the website http://docs.getmobit.ru unless otherwise provided by the revision of the documents itself.
2.1. The Company, under the terms of a simple (non-exclusive) license, grants the User a non-transferable right to use the Application for its direct functional purpose, for which the User is given the right to copy and install (copy) it on the User's Mobile device.
2.2 The license shall be granted on the following terms:
The territory of the License includes all countries of the world;
The term of the License is from the date the User starts using the Application and accepts the terms of the Agreement for the duration of the exclusive rights (indefinitely).
3.1. The User undertakes to properly comply with the terms hereof.
3.2. Except for the use to the extent of and in the ways expressly provided for by this Agreement or the legislation of the Russian Federation, the User has no right to change, decompile, disassemble, decrypt and perform other actions with the object code and source text of the Application with the purpose of obtaining information on the implementation of the algorithms used in the Application, create derivative works using the Application, and also exercise (authorize) other use of the Application, any components of the Application, images and other data stored by the Application on the User's Mobile device, without the written consent of the Company.
3.3. The User gives GETMOBIT consent to the processing of his/her personal data, to the transfer of the User's personal data to GETMOBIT partners, as well as to the processing of personal data by GETMOBIT partners. The processing of the User's data by GETMOBIT shall be carried out on the terms of the Privacy Policy, solely for the purpose of using the Application by the User for its functional purpose.
4.1. GETMOBIT shall not be responsible in case of failures while downloading the Application to the User's mobile device.
4.2. GETMOBIT shall not be responsible: for direct or indirect damage incurred by the User as a result of using/not using the Application.
4.3. GETMOBIT has the right to block the User's access to the Application without warning in case if by his/her actions the User offends, humiliates, threatens, discredits or otherwise violates the rights of third parties, and also violates the norms of international law and the current legislation of the Russian Federation.
5.1. The Application is provided as is. GETMOBIT cannot provide guarantees regarding the error-free and uninterrupted operation of the Application or its individual components and/or functions on your Mobile device, however, we strive to improve the quality of our Applications. GETMOBIT also cannot provide guarantees regarding the conformity of the Application to the specific goals of the User, does not guarantee the accuracy, completeness and timeliness of the information received by the User, and does not provide any other guarantees not expressly specified in this Agreement.
5.2. All actions performed using the Application are considered actions performed by the User.
5.3. The User has the right to direct all questions and claims related to the use/inability to use the Application, as well as possible violation by the Application of legislation and/or the rights of third parties to GETMOBIT.
5.4. This Agreement and all relations related to the use of the Application shall be governed by the legislation of the Russian Federation.
6.1. This Agreement applies to all subsequent updates/new versions (next releases) of the Application. By agreeing to install an update/a new version of the Application, the User also accepts the terms of this Agreement for the corresponding updates/new versions of the Application, unless the update (installation of a new version) of the Application is accompanied by another agreement.
7.1. This Agreement may be amended by GETMOBIT unilaterally without any special notice. Changes to the terms of this Agreement shall be published on the Internet at: http://docs.getmobit.ru/terms_of_use_en.html . When making changes in the current edition, the date of the last update is indicated. The new edition of the Agreement comes into force from the moment of its publication, unless a different procedure for entry into force is provided.
